Federal prosecutors aren't charging nine people arrested in the Capitol complex last month.

In the Longworth House Office Building, nine people were arrested voluntarily on Jan. 6, 2021, during the Capitol insurrection.

Despite being invited and never asked to leave, the nine arrested had not been asked to leave.

Robert Smigel, Triumph the Insult Comic Dog's voice actor, was among nine people arrested by Capitol Police.

U.S. attorney's office decision is respected by Capitol Police.

The group was arrested for unlawful entry after failing to follow instructions before entering the Congressional buildings.

Police told some of the group of nine they would be escorted by congressional staffers, the U.S. attorney's office said.

U.S. attorneys explain that they must prove beyond a reasonable doubt that these invited guests were unlawfully present.
